Terms of Service

Welcome to Bcome – AI Life Coach, operated by Devend FZCO. By using our mobile application, you agree to these Terms of Service.

1. Description of Service

Bcome is a personal development and mental wellness application that provides:

  • AI-Powered Coaching: Personalized guidance from an AI mentor
  • Habit Tracking: Create, track, and build positive habits
  • Goal Setting: Set and manage personal goals with milestones
  • Journaling: Reflect on emotions, thoughts, and behaviors
  • Time Tracking: Monitor how you spend your time
  • Weekly Insights: AI-generated analysis of your patterns and progress
  • Voice Input: Speak instead of type for faster input

The app is intended for personal use by individuals seeking self-improvement and is not a substitute for professional mental health treatment.

2. Eligibility

By using Bcome, you confirm that:

  • You are at least 13 years of age
  • If under 18, you have parental or guardian consent
  • You have the legal capacity to enter into this agreement

3. Accounts

3.1 Creating an Account

You may create an account using:

  • Sign in with Apple
  • Sign in with Google
  • Email and password

3.2 Account Security

You agree to:

  • Keep your login credentials secure
  • Not share your account with others
  • Notify us immediately of any unauthorized access
  • Take responsibility for all activity under your account

3.3 Account Deletion

You may delete your account at any time through the app settings or by contacting us. Upon deletion, all your data will be permanently removed within 30 days.

4. Subscriptions & Payments

4.1 Free & Premium Features

Bcome offers both free features and premium features through subscription.

4.2 Subscription Terms

By subscribing, you agree that:

  • Payment is charged to your Apple ID account
  • Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
  • You can manage and cancel subscriptions in your Apple Account Settings
  • Prices may vary by region and are displayed in the App Store

4.3 Refunds

We do not directly issue refunds. Refund requests must be directed to Apple, who may grant refunds at their discretion according to their policies.

4.4 Price Changes

We may change subscription prices. You will be notified in advance, and new prices will apply to your next billing cycle if you continue your subscription.

5. User Responsibilities

5.1 Acceptable Use

You agree to:

  • Provide accurate information
  • Use the app for its intended purpose of personal development
  • Respect the service and other users
  • Comply with all applicable laws

5.2 Prohibited Conduct

You may NOT:

  • Attempt to reverse-engineer, hack, or disrupt the service
  • Use the app to harm yourself or others
  • Share AI-generated content in ways that misrepresent its source
  • Use automated systems or bots to access the service
  • Violate any applicable laws or regulations
  • Attempt to bypass subscription requirements

6. AI-Generated Content

6.1 Nature of AI Content

Bcome uses artificial intelligence to provide:

  • Coaching responses
  • Pattern analysis
  • Habit and goal suggestions
  • Weekly insights
  • Voice transcription

6.2 Important Disclaimers

By using AI features, you understand and agree that:

  • AI is not a licensed therapist, doctor, or mental health professional
  • AI-generated content may occasionally contain errors or inconsistencies
  • You are responsible for evaluating and acting on AI suggestions
  • AI insights are based on patterns in data you provide and may not capture your full situation
  • The AI cannot diagnose, treat, or cure any condition

6.3 Emergency Situations

Bcome is NOT an emergency service.

If you are experiencing a mental health crisis, suicidal thoughts, or are in danger, please:

  • Call emergency services (911 in the US, or your local equivalent)
  • Contact a crisis hotline
  • Seek immediate professional help

7. Voice Recording & Transcription

7.1 Consent

By using voice input features, you consent to:

  • Temporary recording of your voice
  • Transmission of audio to our servers for transcription
  • Storage of transcribed text

7.2 Voice Data Handling

  • Audio recordings are transmitted securely
  • Recordings are deleted immediately after transcription
  • Only transcribed text is stored
  • You can use text input instead if you prefer

8. Privacy & Data

Your privacy is important to us. Our data practices are described in our Privacy Policy.

By using Bcome, you agree to our Privacy Policy, including:

  • Collection of personal and wellness data
  • Use of AI services for content generation
  • Analytics for app improvement

9. Intellectual Property

9.1 Our Property

All app content, including but not limited to:

  • App design and user interface
  • Branding, logos, and trademarks
  • AI models and algorithms
  • Written content and documentation

is owned by Devend FZCO or its licensors and is protected by intellectual property laws.

9.2 Your Content

You retain ownership of content you create (journal entries, goals, etc.). By using the service, you grant us a license to:

  • Store and process your content to provide the service
  • Use anonymized, aggregated data to improve our AI (no personally identifiable information)

9.3 Restrictions

You may NOT:

  • Copy, modify, or distribute the app or its content
  • Use our branding without permission
  • Commercially exploit any part of the service
  • Claim AI-generated content as professional advice

10. Third-Party Services

Bcome integrates with third-party services:

  • Apple: Authentication and payment processing
  • Google: Authentication
  • Supabase: Data storage
  • OpenAI: AI processing
  • AppsFlyer: Analytics
  • Superwall: Subscription management

These services have their own terms and privacy policies. We are not responsible for third-party service practices.

11. Service Availability

11.1 Availability

We strive to provide reliable service but do not guarantee:

  • 100% uptime or availability
  • Uninterrupted access
  • Error-free operation

11.2 Maintenance

We may temporarily suspend service for:

  • Maintenance and updates
  • Security patches
  • Infrastructure improvements

We will try to provide advance notice when possible.

12. Termination

12.1 By You

You may stop using Bcome and delete your account at any time.

12.2 By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in prohibited conduct
  • Misuse the service
  • Fail to pay for subscriptions
  • Pose a risk to other users or the service

12.3 Effect of Termination

Upon termination:

  • Your access to the service will be revoked
  • Your data will be deleted per our retention policy
  • Active subscriptions will not be refunded for the remaining period

13. Disclaimers

Bcome is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

13.2 No Professional Advice

  • Bcome does NOT provide medical, psychological, psychiatric, or professional advice
  • AI coaching is for informational and self-improvement purposes only
  • Always consult qualified professionals for health concerns

13.3 No Guarantees

We do not guarantee:

  • Specific results or outcomes
  • Accuracy of AI-generated insights
  • Suitability for your specific situation
  • That the service will meet all your needs

14. Limitation of Liability

To the maximum extent permitted by law:

14.1 We Are Not Liable For:

  • Any indirect, incidental, special, or consequential damages
  • Loss of data, profits, or goodwill
  • Damages from service interruptions
  • Errors in AI-generated content
  • Actions taken based on AI suggestions
  • Third-party service failures

14.2 Maximum Liability

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

14.3 Jurisdictional Limitations

Some jurisdictions do not allow limitations of liability, so these limitations may not fully apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

15. Indemnification

You agree to indemnify and hold harmless Devend FZCO, its officers, employees, and affiliates from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights

16. Dispute Resolution

16.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us to attempt to resolve any dispute informally.

16.2 Governing Law

These Terms are governed by the laws of the United Arab Emirates.

16.3 Jurisdiction

Any disputes shall be resolved in the courts of Dubai, United Arab Emirates, unless otherwise required by applicable consumer protection laws in your jurisdiction.

17. Changes to Terms

We may update these Terms periodically. If we make significant changes:

  • We will notify you within the app
  • We will update the "Last Updated" date
  • Continued use after changes constitutes acceptance

If you disagree with changes, you should stop using the service and delete your account.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Devend FZCO regarding Bcome.

18.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

18.3 No Waiver

Our failure to enforce any right does not constitute a waiver of that right.

18.4 Assignment

We may assign our rights under these Terms. You may not assign yours without our consent.
